MIGRANT SMUGGLING: THE OCCURRENCE OF TRANSNATIONAL ORGANIZED CRIME IN THE BRAZILIAN CONTEXT IN THE LAST DECADE

Resumen

Migration is a complex social phenomenon, estimated to exist, according to the latest data from the United Nations High Commissioner for Refugees, on the international stage, 258 million migrants (UNHCR, 2019). These offsets do not occur safely, orderly, and regularly. On the contrary, the social phenomenon of migration, as mentioned, generates implications for the lives of those who move and cross transnational borders, such as that recorded in Brazilian territorial currencies. In general, these displaced persons are victims of sexual and gender-based violence. And in this scenario there are even children who are arrested for the purpose of determining their migration status, as well as being stereotyped as "illegal." However, it is important to point out that no human being can be considered legally illegal. In this sense, the article presents itself as a qualitative survey, based on the deductive methodological procedure. The data collection will take place through documentary and bibliographic analysis, at national and international level, especially articles from specialized international journals on the topic. In addition, the laws and regulations drawn up by the Legislative and Executive Branches in Brazil will be consulted on existing policies on the subject of study. A survey of conventions, protocols, and other international instruments to assist in understanding the reality studied will be carried out.
